Terms and Conditions of Participation with Al-Makeen Al-Amin for tourism is a Saudi entity registered with the Ministry of Commerce, Commercial Register No. (4031221987), and authorized by the Ministry of Tourism under License No. (73104216).
Introduction
These terms and conditions, along with their provisions, govern any use of the electronic platform of Al-Makeen Al-Amin for tourism . Your use of the platform signifies your complete acceptance of all these terms and conditions. If you do not agree with them or any part thereof, you must refrain from using the platform.
The platform
The platform is an electronic service owned by the Al-Makeen Al-Amin for tourism. Its purpose is to facilitate the organization of both internal and external tourist trips through a variety of diverse packages, ensuring the highest level of organization and adherence to stringent safety standards.
Platform Parties
Founder: denotes Al-Makeen Al-Amin for tourism, the proprietor of the platform.
Client: refers to any individual or legal entity acting as the user who has submitted a request for one of the platform’s services.
Authorizer: Any legal entity designated by the Customer to utilize the Platform.
Register on the platform
To access the services of Al-Makin Al-Amin, registration on the platform is required using either an email address or a mobile number.
The information necessary for registration includes: (full name – identification number – date of birth – proof of payment – emergency contact number).
Upon fulfilling the registration process requirements on the platform and submitting the necessary documents, the client and/or the authorized individual, upon receiving their username and password, assume responsibility for safeguarding the confidentiality of this information and refraining from disclosing it to others.
The services are to be utilized by the customer or an authorized individual through the platform in a lawful manner and solely for legitimate purposes, in accordance with the terms and conditions outlined on the website.
By booking or participating in a trip or any product or service associated with Al-Makin Al-Amin Tours Organization, you signify your acceptance of these terms and conditions (“Terms”).
Prior to making a booking, you must confirm that you have read, understood, and agree to be bound by these terms and conditions. When booking on behalf of another individual, you must affirm that you possess the authority to accept the terms and conditions and subsequently agree to them on behalf of the person you represent. The booking is deemed confirmed, and the booking contract is established when the Tour Operator issues a written confirmation statement upon receipt of the required funds. Therefore, please verify that the confirmation is accurate and report any errors, inaccuracies, or incorrect information to the Tour Operator or the responsible party at your earliest convenience. Additionally, ensure that the names are correct and correspond with those recorded in the passport.
Utilization of the platform
To utilize this platform, you must be at least 18 years of age.
You affirm that you possess full legal capacity to enter into this agreement and utilize this platform in accordance with the terms and conditions outlined herein. You agree to assume legal responsibility for all actions and financial obligations arising from your use of this platform, including any use of your account by others, without limitation, such as minors residing with you. Prior to utilizing any services available on the platform, the customer or authorized party is required to review and comply with all terms and conditions published on the institution’s website, as these terms, policies, and the registration form on the platform are deemed integral to and complementary of these terms and conditions.
The Client is required to inform the Institution directly of any unauthorized use of the Platform by the Commissioner or others, including, but not limited to, instances of suspicion or doubt in the event that the account is compromised and utilized without prior consent or authorization.
The customer is required to promptly notify the institution of any changes to the information previously submitted during the registration process on the platform. The institution shall not be liable for any damages arising from the customer’s delay in reporting such changes or for any unlawful activities resulting from the failure to report.
The customer is subject to the institution’s authority to delete, suspend, halt, modify, refrain from registering, or not activate any request on the platform as necessary, without any liability on the part of the institution, provided that this does not impact any existing paid requests.
The customer acknowledges that requesting any services through the platform does not imply the institution’s acceptance, guarantee, or obligation to deliver the service.
The customer acknowledges that any links, references, or advertisements for other links or websites do not imply or signify any form of endorsement or approval by the institution regarding their contents and that the institution is not liable for the opinions, ideas, viewpoints, statements, and information presented therein.
Specialized requirements
You are required to disclose any special needs to the Tour Operator at the time of booking. The Tour Operator will make every effort to accommodate these needs and requirements; however, fulfillment may not always be possible due to the varying nature of the destinations. Additionally, certain activities may not be available. Furthermore, you must inform the Tour Operator of any special dietary requirements at the time of booking; however, the Tour Operator cannot guarantee that these requirements will be met. Moreover, these special requirements do not constitute part of the terms and the contract between you and the Tour Operator, and the Tour Operator will not be held liable for any failure to accommodate these special requests or requirements.
Age Criteria
Individuals under 18 years of age at the time of booking are classified as minors. These minors must be accompanied by an adult. An adult may accompany up to two minors. The age of the minor must be provided at the time of booking, unless otherwise specified by the tour operator.
All bookings that include minors must undergo review by the Tour Operator and receive approval by obtaining consent from a parent, guardian, or other legally responsible individual for the minor’s travel. The guardian is accountable for supplying all necessary consents and documentation, as well as ensuring compliance with all legal travel requirements. The Tour Operator shall not be held liable for any fees, damages, or losses resulting from the failure to provide all requisite consents and authorizations.
Each guardian is accountable for the behavior, oversight, and management of minors and consents to all terms and conditions on behalf of these minors during the booking process. The Tour Operator will not offer any care for minors and will not assume responsibility for their supervision or accompaniment.
Compulsory insurance stipulations
You are required to possess travel insurance that includes medical, educational, and repatriation coverage of no less than US$200,000. This insurance must encompass personal injury or emergency medical expenses from the commencement of each trip. A representative from the tour operator will confirm that you are sufficiently insured. It is advisable to consider augmenting your insurance to encompass cancellation or other expenses arising from loss, damage, or injury during the trip. You must acknowledge that insurance coverage is not factored into the trip cost and that any additional expenses must be borne by you. It is your responsibility to inform your guarantor about the nature of the travel, destination, and activities included in your reservation to ensure the necessary coverage is in place.
Prices, fees, and taxes
The pricing of tours, services, or products published by the Tour Operator is subject to change at any time, both prior to and following the confirmation of a booking, within 30 days of departure. Once confirmation is received and an invoice is issued by the Tour Operator, the operator reserves the right to apply additional charges to the booked products and services due to factors such as increases in transportation costs, fuel prices, currency fluctuations, taxes, and fees associated with specific services like loading and unloading, as well as any government-imposed tax increases that affect service and product pricing. Upon confirming any price increase for services or products, the Tour Operator will notify you at the earliest opportunity.
Airfare cost
The cost of the trip excludes international or additional air tickets, unless specified in the trip description. The tour operator will provide the most competitive prices available at the time of the trip. These quotations are approximate and not final, and they are not necessarily binding on the tour operator or the airline.
Air transportation is governed solely by the terms and conditions of the air carrier, rather than those of the tour operator, which pertain specifically to the purchase and use of the air ticket. Consequently, it is essential to request a copy of the applicable terms and conditions from the air carrier, including information on cancellations and other relevant details. The tour operator bears no responsibility for alterations to the flight program or schedule and does not furnish any information or notifications concerning the flight, including ticket details, flight status, delays, or rescheduling.
Flexibility and underutilized services
You acknowledge that the essence of adventure travel necessitates flexibility, and the Tour Operator will offer reasonable alternatives to products, services, and itineraries. Routes, schedules, accommodations, activities, and modes of transportation may be altered without prior notice due to unforeseen circumstances and events beyond the control of the Tour Operator, including but not limited to force majeure, illness, mechanical breakdowns, cancellations, political events, or border issues. No refunds, reductions, or reimbursements will be issued for services that are disregarded or not utilized after the Tour has commenced, provided that this is not attributable to the Tour Operator’s fault.
Tour Policy
The client is dedicated to upholding the behaviors and ethics that reflect the values, principles, and identity of society, encompassing the prevailing customs, traditions, and culture, in alignment with the applicable systems and laws of each country.
When in a public setting, the client is required to don modest clothing or attire that does not display immoral images, phrases, political symbols, or any content that may offend public sensibilities.
The client acknowledges full awareness of all types of risks associated with trips, irrespective of their nature or severity. The client assumes sole responsibility for any resulting consequences and releases the institution, its employees, and contractors from any material or moral claims arising from such risks.
The customer acknowledges possessing the requisite physical fitness prior to enrolling in any program, taking into account the specific circumstances of each trip. Consequently, the customer is obligated to inform the organization of any health issues, illnesses, psychological conditions, or other factors that may impede participation in any trip. The organization reserves the right to exclude the customer without refunding any amounts, and the customer assumes responsibility for any additional fees incurred as a result.
During the trip, the customer acknowledges complete adherence to the directives of the leader or their representative, as these directives are authoritative and conclusive. Should these instructions be disregarded in whole or in part, the institution or trip leader, or their representative, reserves the right to remove the customer from the site without any refund, and the customer assumes responsibility for any additional costs incurred as a result.
The customer is required to supply and don the necessary equipment and attire for the trip, as the institution does not assume responsibility for providing these items. Furthermore, the institution disclaims any legal liability for any consequences arising from the failure to provide or wear them.
Limit access
The institution reserves the right to limit the customer’s access to some or all services on the platform at its sole discretion. The customer agrees to refrain from using the platform in any manner that causes or may cause damage, or that impairs the availability or accessibility of the platform. Furthermore, the customer shall not engage in any illegal, unlawful, fraudulent, or harmful activities, nor shall they copy, store, host, transfer, send, use, publish, or distribute any materials that contain or are associated with spyware.
Fees
To utilize the services on the platform, the customer is required to pay the fees established for each service for the benefit of the institution. These fees do not encompass, but are not limited to, value-added tax and any additional charges that may be levied by the relevant authorities.
The institution reserves the right to modify or introduce any fees, applicable to both existing and new services, features, or benefits in the future. Such modifications and additions shall be deemed valid and binding.

payment method
The total amount is payable upon confirmation of the reservation, also via bank transfer to one of the institution’s accounts. We maintain a record of orders and payments, which can be accessed in your personal file.
privacy policy
Without prejudice to the customer’s rights concerning their intellectual property and their right to safeguard their privacy, all data entered into the platform, including names, addresses, and both personal and official information, is the exclusive property of the institution. The information collected prior to, during, or after the provision of services is maintained in strict confidentiality. However, this information may be disclosed in response to an official request from a regulatory or supervisory authority or pursuant to a court order. The institution may develop databases for various purposes, generate reports and statistics, and utilize them as it sees fit, including for marketing and promotional activities.
Without prejudice to the client’s rights, including but not limited to photographing landscapes and museums, he is not permitted to photograph individuals or publish such images without securing written or electronic consent from the institution. In all instances, the institution disclaims any liability for lawsuits or responsibilities arising from violations of applicable laws, while reserving its legal rights to take action against the offender.
The institution reserves the right to utilize photographs and videos captured of the customer during the trip in any manner it deems appropriate, including for advertising, marketing, and other commercial purposes. These materials may be published through the institution’s website and social media accounts. Photographs and videos taken by the institution, trip leader, or its employees are considered the property of the institution, unless the institution or leader is informed prior to the trip that the customer does not wish for photographs or videos to be taken, retained, or published.
Limits of Liability
The Foundation shall not be held liable for any damages, losses, or harm of any nature arising from or related to access to or inability to access this platform, nor for the use of or reliance on any information provided through this platform, including, but not limited to, viruses that may infect computer equipment, software, or data, to the fullest extent permitted by law. Furthermore, the Foundation shall not be liable for damages resulting from the use of electronic means of communication, including, but not limited to, damages arising from delays, failure to deliver electronic messages, interception or tampering with electronic communications by third parties, or computer programs utilized to send electronic messages and viruses.
The institution will undertake the necessary efforts and diligence to manage the technical risks that may impact the course and performance of operations related to the platform, and it assumes responsibility for errors arising from the negligence, oversight, or misconduct of its employees. However, it simultaneously disclaims any liability for interruptions or unavailability of the services/platform due to circumstances beyond the institution’s control, such as network connectivity failures or force majeure events, including but not limited to natural disasters, wars, or regulatory or supervisory restrictions. In all instances, the company’s liability shall not exceed ten percent (10%) of the damages substantiated by a final and conclusive court ruling.
The customer acknowledges that the institution disclaims any responsibility, either partially or entirely, for any delays, cancellations, changes, or failures to deliver any of the programs, trips, or related services, whether caused by a third party, force majeure, emergency circumstances, adverse weather conditions, or as sanctioned by the relevant authorities.
The customer acknowledges that the institution disclaims all responsibility, either partially or entirely, for any risks associated with the trips in which the customer participates, whether within or outside the territory of the Kingdom of Saudi Arabia, including political, social, or economic risks.
The customer acknowledges that the institution disclaims any responsibility, whether in part or in full, for any delay, cancellation, alteration, or negligence concerning the customer’s reservations with third parties, including but not limited to airlines. Furthermore, the customer waives the right to seek a refund of flight fees from the institution if unable to attend the designated reception location.
General Provisions
The customer acknowledges that he has no right to assign, delegate, or transfer any of the tourist programs or trips to any other party without securing written or electronic approval from the institution.
The customer acknowledges that should there be a breach of any clause, condition, or provision outlined in these terms and conditions, or if the institution becomes aware of any misconduct or behavior, irrespective of its nature, the institution reserves the right to prohibit the customer from utilizing any of the services offered through the platform, without compensation or participation in future trips.
The customer affirms that all information and documents submitted to the institution or uploaded through the platform are accurate and not misleading, and he assumes full responsibility in the event of a violation before the appropriate authorities.
The client acknowledges his awareness of and commitment to the anti-money laundering and anti-terrorism laws and regulations currently in effect in the Kingdom, as well as his adherence to the stipulations contained therein.
Occasionally, certain facilities referenced in the description may be temporarily unavailable due to factors such as weather conditions, maintenance requirements, or insufficient demand from guests.
Should suppliers recommend substantial modifications to the description or the removal of any essential amenities at the facility, we will promptly inform the customer.
Certain activities and facilities, such as water sports, are not available year-round, and additional charges may apply for specific amenities, including hiking, safaris, diving, camping, jet skiing, and boating in select destinations. During the high season, and occasionally at other times, there is a likelihood of encountering noise from various groups; therefore, please consider this when selecting your destination and accommodation.
The duration required to travel from the airport to the residence and vice versa, as indicated on the platform, is an estimate and may vary based on circumstances. It could take longer to arrive at your selected residence.
If any of these Terms is deemed partially invalid, the parties shall remain bound by the remaining provisions. The parties shall substitute the invalid portions with texts that reflect the correct, legal, and effective provisions, aligning as closely as possible with the original content and meaning of these Terms.

Modifications
The customer acknowledges that the institution reserves the right to modify any of the services, terms and conditions, or platform usage policy at any time. Such modifications will take effect immediately upon publication on the platform and will be binding. In all instances, the customer’s continued use of the platform following the publication of the amendments shall be deemed as acceptance of their content.
Governing law
These terms and conditions are governed by the relevant laws and regulations of the Kingdom of Saudi Arabia. In the event of any dispute concerning the interpretation or application of these provisions, it shall be resolved amicably; if a resolution cannot be reached, the matter will be referred to the appropriate judicial authority in the city of Makkah Al-Mukarramah.
Cancellation and Refund Policy for Domestic Flights (Within the Kingdom of Saudi Arabia) In the event of a cancellation request made 14 days or more prior to the flight date, the institution will retain the full amount as a credit for the customer, to be utilized within a maximum period of one calendar year. Alternatively, the amount may be refunded after deducting a 10% administrative fee, with the refund processed to the customer’s account registered with the institution within 20 working days from the date of receipt of the request.
In the case of a cancellation request made 7 to 14 days prior to the trip date, the company will retain 50% of the trip value, and the remaining balance will be refunded to the customer’s account within 20 business days from the date the request is received.
In the case of a cancellation request made between 72 hours and 7 days prior to the flight date, the company will retain 50% of the flight value, while the remaining amount will be held as a balance for the customer, to be utilized within a maximum period of one calendar year.
In the case of a cancellation request made less than 72 hours prior to the flight date, the institution will retain the entire amount without compensation or program replacement.
If a customer requests to substitute another customer without canceling the trip, an administrative fee of 10% of the trip value will be charged, in addition to any other applicable fees.
The customer acknowledges his obligation in the event of a trip cancellation request as outlined in the aforementioned cases; his request will be processed in accordance with the stipulations of the cancellation policy.
The customer acknowledges the institution’s right to cancel, modify, or replace the trip or program for any reason. In the event of cancellation, the institution’s liability is limited to refunding the amount paid to the customer’s account within 20 working days, without any additional compensation. The institution disclaims responsibility for any amounts the customer has paid as a result of this action.
Cancellation and Refund Policy for International Flights (Outside of Saudi Arabia)
In the event of a request to cancel the reservation between 21 to 29 days prior to the trip date, the institution will retain 50% of the trip value. The remaining amount will be refunded to the customer’s account within 20 working days from the date the request is received, ensuring that the refund is processed to the account registered with the institution.
In the case of a cancellation request made between 14 hours and 20 days prior to the flight date, the company will retain 50% of the flight value, while the remaining balance will be held for the customer to utilize within a maximum period of one calendar year.
In the case of a cancellation request made less than 14 days prior to the flight date, the institution will retain the entire amount without compensation or program replacement.
If a customer requests another individual to take their place without canceling the trip, and this request is made between 48 hours and 13 days prior to the trip date, the institution and relevant authorities must approve the replacement. In such cases, an administrative fee of 10% of the trip value will be charged, in addition to any other applicable fees.
The institution retains the right to cancel the trip or program, or any customer’s participation therein, immediately and without justification, in accordance with the aforementioned policy, or if the minimum requirements for the trip or program are not met. The customer will be informed in the event of such cancellation. The institution’s liability in the case of cancellation is confined to refunding the amount paid to the customer’s account within 20 working days, without any additional compensation, and the institution disclaims any responsibility for any amounts expended by the customer as a result.
In the case of an emergency or force majeure, the following procedures will be implemented:
Postponing the trip or program until the force majeure or emergency has concluded, and establishing an alternative date in accordance with the institution’s policy.
The institution retains the entire amount as a credit for the customer, which may be utilized within one calendar year from the date of cancellation, or for transferring the trip/program to another comparable area.
In the event that the client is infected or suspected of having any infectious disease, documentation of the infection or suspicion must be submitted to establish an alternative date in accordance with the institution’s policy, provided that the postponement applies solely to the infected or suspected client and their first and second-degree relatives.
